Article 1 (Purpose)
The purpose of these terms and conditions is to prescribe the rights, obligations, and responsibilities of cybermalls and users in using Internet-related services (hereinafter referred to as βserviceβ) provided by βhttps://hybrithm.com β(hereinafter referred to as βmallβ) operated by Hybrithm Co., Ltd.
β» βThese terms and conditions shall apply mutatis mutandis to e-commerce using PC communication, wireless, etc., unless contrary to their nature.β
Article 2 (Definitions)
β The term βmallβ means a virtual business establishment established by Hybrithm Co., Ltd. to provide goods or services (hereinafter referred to as βgoods, etc.β) to users, and also means a business operator operating a cyber mall.
β‘ The term βuserβ means a member or non-member who accesses the βmallβ and receives the services provided by the βmallβ pursuant to these terms and conditions.
β’ The term βmemberβ means a person who has registered as a member of the βmallβ and can continuously use the services provided by the βmallβ.
β£ The term βnon-memberβ means a person who uses the services provided by the βmallβ without joining a member.
Article 3 (Clarification and explanation, revision of terms and conditions, etc.)
β βMallβ posts the contents of these terms and conditions, the name of the representative, the address of the business office (including the address of the place where consumers can handle complaints), phone number, e-mail address, business registration number, mail order number, and personal information management manager on the mallβs initial service screen (front). However, the contents of the terms and conditions can be viewed by the user through the connection screen.
β‘ βBefore the user agrees to the terms and conditions, the mall should seek user confirmation by providing a separate connection screen or pop-up screen so that users can understand important contents such as withdrawal of subscription, delivery responsibility, and refund conditions.
β’ The βMallβ may amend the terms and conditions to the extent that it does not violate related laws such as γthe Consumer Protection Act in E-Commerceγ, γthe Regulation of Termsγ, γthe Framework Act on Electronic Documents and Electronic Transactionsγ, γthe Electronic Signature Actγ, γthe Act on Promotion of Information and Information Protectionγ, etc.
β£ If βMallβ amends the terms and conditions, it shall be announced on the initial screen of the mall along with the current terms and conditions from 7 days before the date of application to the day before the date of application. However, if the terms and conditions are changed against the user, it will be notified with a grace period of at least 30 days in advance. In this case, the βmallβ clearly compares the contents before and after the revision and displays them for users to understand.
β€ If βMallβ amends the terms and conditions, the revised terms and conditions apply only to contracts concluded after the date of application, and to contracts already concluded before that date, the terms and conditions before the amendment apply. However, if a user who has already signed a contract sends a message to βmallβ within the notice period of the revised terms and conditions under paragraph 3 and receives the consent of βmallβ, the revised terms and conditions shall apply.
β₯ Matters not prescribed in these terms and conditions and interpretations of these terms and conditions shall be governed by the Consumer Protection Act, the Regulation of Terms and Conditions, and the Consumer Protection Guidelines and related laws or regulations.
Article 4 (Provision and modification of services)
β βMallβ performs the following tasks.
1. Provision of information on goods or services and conclusion of purchase contracts
2. Other duties prescribed by the βMallβ
β‘ βMallβ may change the contents of the goods or services to be provided by a contract to be concluded in the future in the event of a shortage of goods or services or a change in technical specifications. In this case, the contents of the changed goods or services and the date of delivery shall be specified, and the contents of the current goods or services shall be immediately notified to the place where they are posted.
β’ If the contents of the service contracted with the user to be provided by the βMallβ are changed due to the lack of goods, etc. or changes in technical specifications, the reason shall be immediately notified to the user at the address where it can be notified.
β£ In the case of the preceding paragraph, the βmallβ shall compensate the user for the damage caused by this. However, this is not the case if the βmallβ proves that there is no intention or negligence.
Article 5 (Interruption of services)
β The βMallβ may temporarily suspend the provision of services in the event of a repair inspection, replacement, failure, or loss of communication of information and communication facilities such as computers.
β‘ The βmallβ shall compensate the user or a third party for damages caused by the temporary suspension of the provision of services due to the reasons referred to in paragraph (1). However, this is not the case if the βmallβ proves that there is no intention or negligence.
β’ If the service cannot be provided due to the conversion of business items, abandonment of business, or integration between companies, βmallβ shall notify the user in the manner prescribed in Article 8 and compensate the consumer according to the conditions originally suggested in βmallβ. However, if the βmallβ does not notify the compensation standard, etc., the mileage or reserves of the users shall be paid to the user in spot or cash corresponding to the currency value used in the βmallβ.
Article 6 (Membership registration)
β The user applies for membership by expressing his/her consent to these terms and conditions after filling out the membership information according to the subscription form set by βMallβ.
β‘ βMallβ shall be register as a member unless it falls under any of the following subparagraphs among users who have applied for membership as shown in paragraph (1).
1. Where an applicant for membership has previously lost his/her membership pursuant to Article 7 (3) of this Agreement, except where he/she has obtained consent to re-enrollment of the βmallβ as a person who has passed three years after losing his/her membership under Article 7 (3).
2. Where there is a false entry, omission of entry, or error in the registration
3. Where it is deemed that registration as a member is significantly hindered by the technology of the βmallβ
β’ The time when the membership contract is established is when the consent of the βmallβ reaches the member.
β£ If there is a change in the matters registered at the time of membership registration, the member shall notify the βmallβ of the change by modifying member information, etc. within a considerable period of time.
Article 7 (Withdrawal of membership, loss of membership qualifications, etc.)
β Members may request withdrawal from βMallβ at any time, and βMallβ will process withdrawal immediately.
β‘ If a member falls under any of the following reasons, βmallβ may restrict and suspend his/her membership.
1. Where false information is registered at the time of application for membership
2. Where the payment of goods, etc. purchased using the βmallβ or other debts borne by members in connection with the use of the βmallβ are not paid on the due date
3. In the case of threatening the order of e-commerce, such as obstructing another personβs use of βmallβ or stealing such information
4. Where an act is prohibited or contrary to public order and customs by using the βmallβ
β’ After the βmallβ restricts or suspends the membership, if the same act is repeated more than twice or the reason is not corrected within 30 days, the βmallβ may lose the membership qualification.
β£ If the βmallβ loses its membership qualification, the membership registration will be canceled. In this case, the member shall be notified of this and given an opportunity to explain for at least 30 days before the membership registration is canceled.
Article 8 (Notification to Members)
β If βMallβ gives notification to a member, it may be the e-mail address designated by the member in advance of the agreement with βMallβ.
β‘ βMallβ may be substituted for individual notifications by posting them on the βMallβ bulletin board for at least one week in the case of notifications to a large number of unspecified members. However, individual notifications are made for matters that have a significant impact on the transaction of the member himself.
Article 9 (Application for purchase and consent to the provision of personal information, etc.)
β A user of the βmallβ shall apply for purchase on the βmallβ by the following or similar means, and the βmallβ shall provide each of the following information in an easy-to-understand manner when the user applies for purchase.
1. Search and selection of goods, etc
2. Enter the recipientβs name, address, phone number, e-mail address (or mobile phone number), etc
3. Confirmation and indication of consent to the contents of the terms and conditions, services with limited right to withdraw subscription, and the burden of expenses such as delivery and installation costs
4. Application for purchase of goods, etc. and consent to confirmation or confirmation of βmallβ
5. Selection of payment method and payment
β‘ If the βmallβ needs to provide the buyerβs personal information to a third party, 1) the person receiving the personal information, 2) the purpose of using the personal information, 3) the item of the personal information to be provided, and 4) the period of personal information retention and use of the person receiving the personal information. (The same is true of changes to the agreed matter.)
β’ If the βmallβ entrusts a third party with the work to handle the buyerβs personal information, the buyer shall be informed of 1) the person entrusted with the handling of personal information, and 2) the details of the work entrusted with the handling of personal information. (The same shall apply if the consent is changed.) However, if necessary for the implementation of a contract on service provision and related to the promotion of convenience of buyers, it is not necessary to go through the notification process and consent process by notifying it through the Personal Information Handling Policy.
Article 10 (Establishment of a contract)
β βMallβ may refuse to accept a purchase application as in Article 9 if it falls under any of the following subparagraphs. However, in the case of signing a contract with a minor, the minor himself or the legal representative must be notified that the contract may be canceled unless the consent of the legal representative is obtained.
1. Where there are false statements, omission of description, or errors in the application
2. Where a minor purchases goods and services prohibited by the Juvenile Protection Act, such as cigarettes and alcohol
3. Where it is determined that consent to the purchase application is significantly hindered by the βmallβ technology
β‘ The contract shall be deemed to have been established at the time when the consent of the βmallβ reaches the user in the form of a notification of receipt under Article 12 (1).
β’ The expression of consent of the βmallβ shall include information on the confirmation of the userβs purchase application, availability of sales, cancellation of correction of the purchase application, etc.
Article 11 (Payment Method)
The payment method for goods or services purchased in βMallβ may be made by any of the following methods. However, βmallβ cannot be collected by adding any nominal fee to the payment of goods, etc. for the userβs payment method.
1. Transfer of various accounts such as phone banking, Internet banking, mail banking, etc
2. Payment by various cards such as prepaid card, debit card, credit card, etc
3. Deposit without an online bankbook
4. payment in electronic money
5. Payment upon receipt
6. Payment by points paid by βmallβ such as mileage
7. Payment by gift certificate signed with βMallβ or recognized by βMallβ
8. Payment, etc. by Other Electronic Payment Methods
Article 12 (Notification of receipt confirmation, change of purchase application, and cancellation)
β βMallβ notifies the user of the receipt confirmation when the user applies for a purchase.
β‘ A user who has received a notification of receipt may request the change or cancellation of the purchase application immediately after receiving the notification of receipt, and the βmallβ shall be processed according to the request of the user before delivery. However, if the payment has already been made, the regulations on the withdrawal of subscription, etc. under Article 15 shall be followed.
Article 13 (Supply of Goods, etc.)
β βMallβ takes other necessary measures such as custom-made, packaging, etc. so that goods, etc. can be delivered within seven days from the date of subscription, unless there is a separate agreement with the user regarding the timing of supply of goods, etc. However, if the βmallβ has already received all or part of the payment for goods, etc., measures shall be taken within three business days from the date of receipt of all or part of the payment. At this time, the βmallβ takes appropriate measures so that users can check the supply procedures and progress of goods, etc.
β‘ βMallβ specifies the means of delivery, the person responsible for the delivery cost by means, and the delivery period by means for the goods purchased by the user. If the βmallβ exceeds the agreed delivery period, the userβs damage shall be compensated. However, this is not the case if the βmallβ proves that there is no intention or negligence.
Article 14 (Refund)
βMallβ shall notify the user without delay when the goods, etc. requested by the user cannot be delivered or provided due to sold out, and shall refund or take necessary measures within three business days from the date of receipt of the payment.
Article 15 (Withdrawal of Subscription, etc.)
β A user who has signed a contract with βMallβ on the purchase of goods, etc. may withdraw the subscription within seven days from the date of receipt of a document on the contract under Article 13 (2) of γThe Consumer Protection Actγ. However, if the withdrawal of subscription is otherwise stipulated in γThe Consumer Protection Actγ, the provisions of the same Act shall apply.
β‘ A user shall not return or exchange goods, etc. in any of the following cases when they are delivered.
1. Where goods, etc. are lost or damaged due to reasons responsible to the user (However, if the packaging, etc. is damaged to confirm the contents of goods, etc., the subscription may be withdrawn.)
2. Where the value of goods, etc. is significantly reduced due to the use or partial consumption of users
3. Where the value of goods, etc. has significantly decreased to the extent that resale is difficult due to the passage of time
4. Where it is possible to duplicate goods, etc. having the same performance, where the packaging of goods, etc., which are the original, is damaged
β’ In the case of paragraph (2) 2 through 4, the userβs withdrawal of subscription is not restricted unless the βmallβ has specified in advance that the withdrawal of subscription is restricted or measures such as providing trial products are provided.
β£ Notwithstanding the provisions of paragraphs (1) and (2), if the contents of goods, etc. are different from the contents of the indication or advertisement, or are implemented differently from the contract, the user may withdraw the subscription within three months from the date of receiving the goods, etc.
Article 16 (Effect of Withdrawal of Subscription, etc.)
β βMallβ shall refund the payment of goods, etc. already paid within three business days when goods, etc. are returned from the user. In such cases, if the βmallβ delays the refund of goods, etc. to the user, the delayed interest calculated by multiplying the delayed interest rate prescribed in Article 21-2 of γthe Enforcement Decree of the Consumer Protection Act in E-Commerce, etc.γ shall be paid.
β‘ In refunding the above payment, βMallβ requests the business operator who provided the payment method to stop or cancel the claim for goods, etc. without delay when the user pays the payment by credit card or electronic currency.
β’ In the case of withdrawal of subscription, the user shall bear the expenses necessary for the return of the supplied goods, etc. βMallβ does not claim a penalty or compensation for damages from the user due to withdrawal of subscription. However, if the contents of goods, etc. are different from the contents of the indication or advertisement, or if the subscription is withdrawn due to different performance from the contents of the contract, the βmallβ shall bear the cost of returning goods, etc.
β£ If the user bears the shipping cost when receiving goods, etc., the βmallβ clearly indicates who bears the cost when withdrawing the subscription.
Article 17 (Personal Information Protection)
β βMallβ collects minimum personal information to the extent necessary for providing services when collecting personal information of users.
β‘ βMallβ does not collect information necessary for the performance of the purchase contract in advance when registering as a member. However, this is not the case that the minimum specific personal information is collected when identification is required before the purchase contract for the performance of obligations under the relevant laws and regulations.
β’ When the βmallβ collects and uses the userβs personal information, it shall notify the relevant user of the purpose and obtain consent.
β£ The βmallβ shall not use the collected personal information for any purpose other than the purpose, and if a new purpose of use occurs or is provided to a third party, the user shall be notified of the purpose and consent shall be obtained at the stage of use and provision. However, exceptions are made if the relevant laws and regulations stipulate otherwise.
β€ If the βmallβ requires the consent of the user pursuant to paragraphs 2 and 3, the personal information management managerβs identity (affiliated, name and phone number, other contact information), the purpose of collecting and using information, and the information provided to third parties (the recipient, purpose of providing, and information to be provided), Article 22 (2) of the Act may be withdrawn at any time.
β₯ Users may request access to their personal information held by βMallβ and correct errors at any time, and βMallβ is obligated to take necessary measures without delay. If the user requests the correction of the error, the βmallβ shall not use the personal information until the correction of the error is made.
β¦ To protect personal information, the βmallβ shall limit the number of persons handling the userβs personal information to a minimum, and shall be fully responsible for the loss, theft, leakage, provision, alteration, etc. of the userβs personal information, including credit cards and bank accounts.
β§ When the βmallβ or a third party who has received personal information from it achieves the purpose of collecting or receiving personal information, the relevant personal information shall be destroyed without delay.
β¨ βMallβ does not set the consent box for the collection, use, and provision of personal information as pre-selected. In addition, services restricted when users refuse to agree to collect, use, and provide personal information are specifically specified, and the provision of services such as membership registration is not restricted or rejected on the grounds of the userβs refusal to collect, use, and provide personal information.
Article 18 (Obligation of βMallβ)
β The βmallβ shall not act prohibited by laws and regulations or contrary to public order and customs, and shall do its best to provide goods and services continuously and stably as prescribed by these terms and conditions.
β‘ The βMallβ shall have a security system to protect usersβ personal information (including credit information) so that users can safely use Internet services.
β’ βMallβ shall be responsible for compensating users for damages caused by unfair labeling or advertising activities prescribed in Article 3 of the Fair Labeling and Advertising Act on Products or Services.
β£ βMallβ does not send commercial e-mails that users do not want.
Article 19 (Obligation to Memberβs ID and Password)
β Except in the case of Article 17, the member is responsible for managing the ID and password.
β‘ Members should not allow third parties to use their IDs and passwords.
β’ If a member has his or her ID and password stolen or recognized that a third party is using it, he or she shall notify the βmallβ immediately and follow the instructions of the βmallβ.
Article 20 (Obligation of Users) Users shall not perform the following actions.
1. Registration of false information at the time of application or change
2. the theft of information from othersβ information
3. Changes to information published in βmallsβ
4. Transmission or posting of information (computer programs, etc.) other than information determined by the βmallβ
5. Infringement of intellectual property rights, such as copyrights of βmallβ and other third parties
6. βMallβ or any other act that damages the reputation of a third party or interferes with his/her work
7. Disclosure or posting of obscene or violent messages, images, voices, or other information contrary to public order in the mall
Article 21 (Relationship between βmallβ and βmallβ to be connected)
β When the upper βmallβ and the lower βmallβ are linked by hyperlinks (e.g., text, pictures, and fairy tales), the former is called the linked βmallβ (website), and the latter is called the linked βmallβ (website).
β‘ The linked βmallβ shall not be liable for the transaction if it is specified as the initial screen of the linked βmallβ or the pop-up screen at the time of connection that the linked βmallβ is not responsible for the transaction.
Article 22 (Restriction on the Attribution and Use of Copyright)
β Copyright and other intellectual property rights to works created by βMallβ belong to βMallβ.
β‘ A user shall not use information attributable to intellectual property rights to βmallβ among the information obtained by using βmallβ for profit or use by a third party by means of reproduction, transmission, publication, distribution, broadcasting or other means without prior consent of βmallβ.
β’ βMallβ shall notify the relevant user of the use of copyright attributed to the user in accordance with the agreement.
Article 23 (Dispute Resolution)
β The βMallβ shall establish and operate a damage compensation handling organization to reflect legitimate opinions or complaints raised by users and to compensate for the damage.
β‘ βMallβ shall handle complaints and opinions submitted by users preferentially. However, if it is difficult to process quickly, the user will be notified of the reason and processing schedule immediately.
β’ Where there is an application for damage relief by a user in connection with an e-commerce dispute between the βmallβ and the user, it may be subject to mediation by the Fair Trade Commission or the dispute mediation agency requested by the city or provincial governor.
Article 24 (Trial Rights and Applicable Acts)
β A lawsuit concerning an e-commerce dispute between the βmallβ and the user shall be subject to the address of the user at the time of filing the lawsuit, and if there is no address, the exclusive jurisdiction of the district court having jurisdiction over the residence. However, if the address or residence of the user is not clear at the time of filing the complaint, or in the case of foreign residents, it is filed with the competent court under the Civil Procedure Act.
β‘ Korean law applies to e-commerce lawsuits filed between βmallsβ and users.
This English version of User Agreement is a translation based on the original Korean version of User Agreement. If there is any conflict between these two versions, the original Korean version of the Terms of Service shall prevail.
